Terms of Service

These Terms of Service ("Terms") govern your use of the website design, hosting, and management services ("Services") provided by Alino Web Design ("we", "us", "our"). By placing an order or using our Services, you ("the Client") agree to be bound by these Terms in full.
1. Services Overview
Alino Web Design provides the following services to UK-based businesses:
- Custom Website Design — Bespoke design and development of a website (up to 5 pages), including mobile-responsive layout, SEO optimisation, contact form integration, and custom domain setup.
- Website Hosting — Ongoing hosting of your website on Cloudflare's global CDN, including SSL certificate, DNS route management, and uptime monitoring.
- Managed Plans — Optional monthly plans that include content updates, analytics reporting, email setup, and priority support depending on the tier selected.
2. Domain Registration and Hosting Management
Crucial Domain Information: Please read carefully to understand your rights and responsibilities regarding your domain name.
2.1 Legal Ownership
Explicitly, while Alino Web Design registers and manages the domain name on your behalf to ensure seamless technical operation, you (the Client) remain the sole legal owner and Registrant of the domain name at all times.
2.2 Domain Transfers & Admin Fees
You are free to transfer your domain to another provider or registrar at any time. Should you request a domain transfer, a one-off £50 Administrative Transfer Fee will be applied. This fee covers the labour required to unlock the domain, provide the EPP/authorisation codes, and facilitate the technical handover to your new provider.
2.3 Hosting & Non-Payment Liability
The continuous renewal of your domain name is intrinsically tied to your active £14.99/month (or chosen tier) hosting subscription. If you fail to pay your hosting fee within the stipulated timeframes, Alino Web Design is not obligated to renew the domain with the registry. We accept zero liability for any loss of business, data, brand identity, or search engine ranking if your website goes offline or if the domain expires and is subsequently registered by a third party.
3. Contract Term & Billing
Important: All hosting plans require a minimum initial commitment of 12 months ("Initial Term"). After the Initial Term, your plan will automatically convert to a rolling monthly contract unless cancelled.
3.1 Initial Term
Upon signing up for any hosting plan (Essential, Managed Growth, or Pro Business), you commit to a minimum period of 12 consecutive months from the date your website goes live. This is referred to as the "Initial Term". You may not cancel your hosting plan during this period.
3.2 Rolling Monthly Contract
After the 12-month Initial Term has been fulfilled, your plan will automatically convert to a rolling monthly contract. You may cancel at any time during the rolling period by providing at least 30 days' written notice to hello@alinowebdesign.com.
3.3 One-Time Design Fee
The custom website design fee is a one-time payment due before work begins. This fee covers the design, development, and initial deployment of your website. It is non-refundable once work has commenced.
4. Payment Terms
4.1 Payment Methods
Monthly hosting fees are payable in advance by direct debit, bank transfer, or such other method as we may agree. Invoices are issued on or around the same date each month.
4.2 Late Payment
If a monthly payment is not received within 7 days of the due date, we will issue a reminder notice. If payment remains outstanding for 14 days after the due date, we reserve the right to restrict access to your website.
Non-Payment: If payment is not received within 30 days of the original due date, your website will be taken offline and all associated services (hosting, email, domain management) will be suspended until the outstanding balance is settled in full.
4.3 Reactivation
If your website has been taken offline due to non-payment, it may be reactivated upon full settlement of all outstanding invoices plus a £25 reactivation fee. We will make reasonable efforts to retain your website files for up to 90 days after suspension, after which they may be permanently deleted.
5. Client Responsibilities & Acceptable Use
The Client agrees to:
- Provide all content (text, images, logos, branding) required for the website in a timely manner.
- Review and approve designs and content within 7 working days of submission, unless otherwise agreed.
- Ensure that all content provided is accurate, lawful, and does not infringe third-party intellectual property rights.
- Not use the website or hosting services for any illegal activities, spamming, malware distribution, or hosting of explicit/prohibited material.
6. Intellectual Property
6.1 Website Design
Upon full payment of the design fee and all outstanding hosting fees, the Client is granted a non-exclusive licence to use the website design. The underlying code, frameworks, and design systems remain the intellectual property of Alino Web Design.
6.2 Client Content
All content provided by the Client (logos, images, copy) remains the property of the Client. The Client grants us a licence to use such content solely for the purpose of delivering the Services.
6.3 Portfolio Use
We reserve the right to showcase completed work in our portfolio and marketing materials unless the Client requests otherwise in writing.
7. Performance, SEO & Compatibility
7.1 Browser Compatibility
We design our websites to function correctly on modern, supported web browsers (e.g., current versions of Chrome, Safari, Firefox, Edge). We do not guarantee compatibility with obsolete or unsupported browsers.
7.2 Search Engine Optimisation (SEO)
While we implement standard best practices for on-page SEO, we do not guarantee specific search engine rankings or traffic volumes. Search algorithms change frequently and are outside of our control.
8. Uptime & Availability
We host all websites on Cloudflare's global content delivery network and aim for 99.9% uptime. However, we do not guarantee uninterrupted service and shall not be liable for downtime caused by factors outside our reasonable control, including but not limited to third-party service outages, DNS propagation, or force majeure events.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability under these Terms shall not exceed the total fees paid by the Client in the 12 months preceding the claim.
- We shall not be liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunity.
- We are not responsible for any losses arising from content provided by the Client or any third-party plugins/integrations requested by the client.
10. Termination
10.1 By the Client
During the Initial Term, the Client may not cancel without paying the remaining balance of the 12-month commitment. After the Initial Term, the Client may cancel with 30 days' written notice.
10.2 By Alino Web Design
We may terminate or suspend Services immediately if the Client breaches these Terms, fails to make payment, or engages in activity that is unlawful or harmful to our operations.
10.3 Effect of Termination
Upon termination, access to the hosted website, email forwarding, and all managed services will cease. We are under no obligation to provide website files or data after termination, though we may do so at our discretion, subject to the £50 administrative transfer fee if a domain transfer is requested.
11. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
